A man shot early Sunday during a burglary has been released from the hospital and is charged with burglary and theft, Attalla Police Chief Lamont Tucker said.
A man shot early Sunday during a burglary has been released from the hospital and is charged with burglary and theft, Attalla Police Chief Lamont Tucker said.
Marquis Jerrail Phillips, 18, was shot in the leg after a man returned home about 2 a.m. Sunday and found two men inside.

Phillips and Davonta Lee Graves, 25, both of Attalla, have been charged with first-degree burglary and first-degree theft of property, Tucker said.
The man who lives at the house on Owens Avenue and his girlfriend got there about 2 a.m., and saw the front door was open and two men were stealing property from the residence. He also saw a vehicle in the driveway that did not belong to him.
One of the burglars had a shotgun in his hand that belonged to the man who lives there. When the resident asked what he was doing, the man with the shotgun — believed to be Phillips — became irate and attempted to load the shotgun, Tucker said.
The man who lives there had a pistol and fired a shot into the ground to try to scare the burglar. Phillips dropped the shotgun and ran down the road, then pulled a pistol from his waistband and pointed it at the house's resident as he ran down the road.
The resident then fired his handgun and shot Phillips in the leg.
Phillips dropped the handgun and ran toward Noojin Street. He no longer was able to run when he reached the intersection of Owens Avenue and Noojin Street, Tucker said. Police caught up with him there and he was taken by ambulance to the hospital for treatment of the wound.
Meanwhile, Graves allegedly was still at the house and tried to talk the resident out of calling the police and tried to get the man's girlfriend to get off the phone.
Graves then allegedly tried to grab her phone, but she rolled up the window on his arm, causing him to turn it loose.
Police responded and when Graves saw them at the corner of the street, he ran.
The St. Clair Correctional Facility dog tracking team was called to respond and tracked the man to the area of Third Street and U.S. Highway 11, where it is believed he got into a vehicle.
He was arrested about 6 a.m. Sunday at an apartment in Attalla where he had been staying.
