A judge has dismissed a capital murder charge against a man accused of killing a missing Homewood mother and ordered him released after more than a year in jail.
An attorney for Joacquas Haywood said the 28-year-old was expected to be released from jail Monday night. Circuit Judge Clyde Jones had criticized the prosecution for what he said was a lack of evidence that Haywood intentionally killed Nadia Kersh during a 2008 burglary.
Haywood's trial was set for Sept. 19. He was arrested in May 2010, two years after the 23-year-old Kersh went missing after she left her job at a market in Homewood. Her body was never found.
Prosecutors were hoping to delay the trial after discovering earlier this month that some evidence had never been tested for DNA.
